PRIVATE MEMBERSHIP ASSOCIATION
NORFOLK PMA
By joining Norfolk PMA ("the Association"), including any website or social media group it runs, I agree to the following:
1. Private association.
I am exercising my right to freedom of association under the U.S. Constitution (First, Fourth, Fifth, Ninth and Tenth Amendments) and the Universal Declaration of Human Rights. Association activities take place in the private domain, between members, as a private contractual matter.
2. Freedom of choice.
I decide for myself which members to seek counsel from, and which services are best for my health, wellness and goals.
3. Services.
The Association offers members consulting and personal training. These services are educational and supportive. They are not medical care, mental health treatment or diagnosis, or legal, tax or financial advice. I will keep any doctor, therapist or other licensed professional I currently use, and I will not stop any prescribed treatment because of Association services.
4. Risks and informed consent.
Personal training: exercise carries risks including soreness, strains, sprains, falls, joint injury and, rarely, heart events or death. I confirm I am physically able to take part or have medical clearance. I will tell my trainer about any health condition, injury, medication or pregnancy before starting and if anything changes. I will stop and report any pain, dizziness, chest discomfort or shortness of breath. Consulting: consulting is information and opinion, not a guarantee of any result. Business, financial, career, health or personal decisions based on it can lead to losses or outcomes I don't expect. I am solely responsible for the choices I make and their results, and I will verify information and consult licensed professionals before major decisions. Sessions may bring up strong emotions or memories. If I am in crisis or under care for a mental health condition, I will seek help from a licensed professional.
5. Assumption of risk and release.
I voluntarily accept the risks above and take responsibility for my own choices. I release the Association, its Trustees, members and staff from claims arising from my participation, except claims caused by gross negligence or intentional misconduct.
6. Voluntary and informed.
I join of my own free will, without pressure or coercion. I have read this agreement, sought enough information to make this choice, and had my questions answered.
7. Not an agent.
I do not represent any local, state or federal agency that regulates products or services, or carries out enforcement, entrapment or investigation.
8. Privacy.
The Association will keep my personal information and records confidential and will not share them without my written consent, unless required by law or needed to protect someone's safety. I will keep confidential what I learn about other members.
9. Disputes and arbitration.
Any dispute between me and the Association or its members will first be brought to the Association for internal resolution. If it is not resolved within 30 days, it will be settled by private binding arbitration, not in court. I waive any right to a jury trial or class action.
10. Governing law.
Wyoming law governs this agreement. Any arbitration will take place in Sheridan County, Wyoming.
11. Membership.
Membership is open to anyone who agrees with these principles, regardless of race, color or religion. Membership begins when the Association accepts this agreement. I may withdraw at any time. The Trustees may end my membership for abusive, violent, harassing or destructive conduct, or conduct detrimental to the Association.
12. Severability.
If any part of this agreement is found unenforceable, the rest stays in effect.
13. Entire agreement.
This is the entire agreement for my membership, effective the date the Association accepts it.
